Rental collections and recovery is the legal process by which the landlord recovers any arrear rent due in terms of a lease agreement.
This is usually initiated by way of a letter of demand followed, typically, by the cancellation of the lease agreement. Should the demand not be adhered to, a summons will be issued and served, the  Landlord’s Hypothec perfected and judgment sought against the tenant. The judgment, coupled usually, with an order for legal costs, can then be executed.
This process is often accompanied by the eviction process, a specialized process.
The effectiveness of this collection and recovery varies depending on the tenant's financial position, but certain strategies can be explored in order to increase the effectiveness in the medium to long term.

  • Levy collections and recovery is the legal process by which a Community Scheme such as a Body Corporate or Homeowners' Association, recovers any arrear levies due by the owners of the units or properties, respectively.
